Victor Alfieri vs. State of New York - Claim No. 128696 - Appellate Court Overturns Decision in Bike Accident Case

On August 15, 2016, Mr. Victor Alfieri was riding a bicycle at the Rockland Lake State Park. While riding, two pedestrians suddenly walked in front of his bike. In an attempt to avoid hitting them, he had to steer his bike toward the asphalt section of the path. While he did so, the front wheel of his bicycle got caught on a broken part of the path. As a result, the bicycle abruptly halted, causing Mr. Alfieri to lose control and fall off his bike. Mr. Alfieri alleged that the accident was caused by the State’s failure and negligence to properly maintain the biking path. As a result, he filed a lawsuit against the State of New York.

The Lawsuit

During the lawsuit, Mr. Alfieri testified that on the day of his accident the weather was clear and it was bright. Mr. Alfieri described the patch where his accident happened being cracked and having broken edges. He further stated that similar patches were prevalent throughout the bike paths around the Rockland Lake. He further testified that he was familiar with the bike path and these broken patches, as he walked or biked the path at least three times a week for the last 15 years. He testified that after his accident, he lay on the ground for at least 45 minutes before the medical assistance arrived. He also stated that he could not make any calls because his hands were numb and tingling. To support his claim, Mr. Alfieri presented pictures of the broken surface before the Court.

Christian Nielsen, the Park Manager testified for the Defendant. He oversaw daily maintenance at Rockland Lake State Park and inspected the bike path 2–3 times every week for hazards. Mr. Nielsen identified the damaged patch in the photos as "minor erosion." He acknowledged that the asphalt surface was worn and needed monitoring, but he did not consider it hazardous. He stated that there were no prior accidents or complaints about that location. Mr. Nielsen also noted that around 7:30 p.m. in August, approximately 50 people would still be in the Park, but by 8:00 p.m., numbers would decrease due to fading daylight and lack of artificial lighting in the area.

Based on the testimonies and evidence presented, the Court noted that Mr. Alfieri was riding his bicycle on a designated biking area around the Rockland Lake. Court also acknowledged that although the path was used by pedestrians, its primary intended use was for biking and it serves as a "designated venue" for that purpose. Based on these findings the Court noted that by voluntarily bicycling on the path, Mr. Alfieri accepted risks inherent to the activity, which are considered an expected part of participation in the sport and dismissed his claim against the State on September 24, 2021. Mr. Alfieri appealed.

The Appeal

In Alfieri vs. State of New York, the Appellate Court reviewed the evidence and testimony presented during trial and formed its opinion on the basis of the applicability of Mr. Alfieri’s assumption of risk. Court validated the Trial Court’s finding that participants in sports or recreational activities consent to inherent and foreseeable risks of the activity, but differentiated Mr. Alfieri’s case stating that this principle generally applies to organized or sponsored activities at designated venues, and not to general recreational use of public spaces. On February 21, 2024 the Appellate Court overturned the Trial Court’s judgment and held that Mr. Alfieri was engaged in casual recreational biking on a public, multi-use path shared with pedestrians. As such, the path was not exclusively for biking, and he did not assume the risk of injury from defective conditions.
